Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Atlas app, website, and services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Your account

You must be at least 13 years old (or 16 in the EEA) to use Atlas. You are responsible for the activity on your account and for keeping your credentials safe.

2. Your content

You keep ownership of the photos, videos, notes, tickets, and stamps you upload ("Your Content"). You grant Atlas a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and improve the Service and to deliver features you enable (such as sharing or exports).

You are responsible for Your Content and confirm you have the rights to upload it.

3. Acceptable use

• No unlawful, harmful, or infringing content.
• No falsifying stamps, forging location data, or gaming the verification system.
• No scraping, reverse engineering, or abusing the API.
• No harassment, spam, or violation of others' privacy.

We may remove content or suspend accounts that break these rules.

4. Subscriptions and billing

Atlas+ is a paid subscription billed monthly or annually in the currency shown at checkout. Subscriptions auto-renew until cancelled. You can cancel at any time; access continues until the end of the current billing period.

Except where required by law, payments are non-refundable. EU/UK statutory withdrawal rights apply where relevant.

5. Free tier

The free tier is provided as-is with the limits described on our pricing page, which may change over time. We will give reasonable notice of material reductions.

6. Intellectual property

The Atlas name, logo, design, and software are owned by Atlas and protected by intellectual property laws. Nothing in these Terms transfers those rights to you.

7. Third-party services

The Service may integrate with third parties (e.g., flight data providers, social platforms). Their terms and privacy policies apply to your use of those services.

8. Termination

You can stop using the Service at any time and delete your account from Settings. We may suspend or terminate the Service, or your access to it, for breach of these Terms or where required by law.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Atlas disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Atlas will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our aggregate liability will not exceed the amount you paid us in the 12 months before the claim, or USD 100 if no amount was paid.

11. Governing law & consumer rights

These Terms are governed by the laws of the jurisdiction in which Atlas is established, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence still apply and are not waived by these Terms, including:

• United States: state consumer-protection and privacy laws (e.g., CCPA/CPRA in California and equivalent laws in Virginia, Colorado, Connecticut, Utah, and Texas).
• Canada: federal (PIPEDA) and provincial consumer-protection and privacy laws, including Québec's Law 25.
• Brazil & Latin America: the Brazilian Consumer Defense Code and LGPD, and equivalent regimes in Mexico, Argentina, Chile, Colombia, and Peru.
• Australia: the Australian Consumer Law (ACL) under Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any guarantee under the ACL that cannot lawfully be excluded.
• New Zealand: the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

12. Changes

We may update these Terms. If changes are material, we will notify you in-app or by email. Continued use after the change means you accept the updated Terms.
